  • HMO & Multi-Lets

    HMO without licence and AST contract

    The Landlord is responsible for the Council Tax in an HMO.

    That's true but remember that a Council Tax HMO has it's own specific definition within Council Tax legislation. There's no need to even get as far as worrying about whether it's a Council Tax HMO or not (as per S8 of the LGFA92) - S6 of the LGFA92 mandates that a resident owner is liable regardless of anything else.

    Thanks everyone for the replies, tomorrow I will go to the Citizend Advice for confirm everything and I will go for a Rent Repayment Order and ask back my deposit too.

    Just to confirm this person feels he has a right to live in someone elses property without paying any money. This is a factual statement.

    You are wrong as before, and you don't have the right to tell what I feel cause you don't know me and you don't know the situation. I have the right to take to court a criminal that I have payed a lot of money for renting an house without the proper licence and lacking all the possible security for me, my girlfriend and other 2 friends, and now he has the courage to ask me more money, he deserve to go to court and pay.

    From the 1 experience that I had I don't have a high opinion of CAB unless they can get you a pro bono lawyer.

    In your shoes I would go to your local authority.
