    To quote from a very good book recommended to me by Fedup Landlord:-

    Categories of property business as far as UK taxation is concerned:-

    a) Property investment (including letting) (investment)

    b) Property development (trading)

    c) Property trading or dealing (trading)

    d) Property management (trading)

    "It is also important to understand that these different types of property business are not exclusive to individual property investors and that these categorizations may also be applied to a property company, a partnership, or any other kind of property investment vehicle"

    Hence, if the intent is to invest in property on a long term buy to let basis, then the taxation will be treated exactly the same (i.e. investment) whether set up as a sole trader or via ltd company SPV.

    That is how part of the tax system works. Other parts work differently.

    I noticed Property 118 has written an open letter to MR Hammond to allow the transfer of BTL into a company with out CGT

    I don't think the proposal will go far but its worth a try
