    Local Authority Relationships

    Hi Guy's,

    Not sure if I am missing parts of the thread but I thought we could still request we are paid LHA from day 1?

    I have a LHA tenant and at the start of the AST we signed all the forms so that we are paid direct, it's been working that way since November 2015.

    I don't have any other LHA at the moment, but if I did I would always say you need to sign the form from day 1 so that we are paid direct.

    My original post was just to state how difficult it can be to work with the LC.

    Yes you can, well the tenant can, request direct payment to the landlord. But they have to state why as the default position is pay them.

    For example they can state social or financial problems.

    My original post came from me asking the LC is the HB claim being processed. And they wouldn't tell me.

    So my guess is 00's has gone to the tenant direct. So just creates more management issues. I have a few properties that only attract a certain customer group. Yeild high. PITA even higher.

    Ive dealt with LHA tenants the last 20 years

    My  relationship with the LA has always been incredibly difficult

    We are not the customer as they see it only the tenant is, so communication with them is always a strain

    They have a bunker mentality and pay lip service to any true integration with LL`s

    They have truly so little  concept of our needs . I have tried so hard to educate them

    They do not listen though and any suggestion I make are met with a brick wall attitude

    So I  work around them and their numerous shortcomings .

    Lack of training , low paid staff, low morale , high workloads

    Having said that all mine are paid direct thanks to the HB amendments regs 2010

    Some councils do not honour that regulation but mine does thankfully

    Without that i would have thrown in the towel a long time ago

    UC will and has set it all back 10 years with payments going to the tenant again

    As a result I have purposely reduced my exposure to the HB market

    UC is not fit for purpose and will in time be drastically reworked or scrapped in its entirety

    I sense though that it will be too little too late 

    Soon it will be time to get my towel out again

    And is there are a way to see which councils do and don't follow this?

    I don't know if the council that pays me direct does or not, but from day 1 they pay us but don't recall reading anything about these regs.

    This is the relevant passage

    (8) In regulation 96(3A)(b)(8) (circumstances in which payment may be made to a landlord)—

    (a)after paragraph (iii) add—

    “or

    (iv)the relevant authority considers that it will assist the claimant in securing or retaining a tenancy.”;

    I dont think there is a generic lists of which councils comply and which don`t

    Its a regulation not a law so they dont have to comply and have discretion

    They came in force April 2011.  My council was not aware of their inception

    So I copied and pasted the reg to them

    They apologised, amended their direct payment form and paid me direct ever since on every claim

    That does not surprise me that somebody in the council office didn't know their own job? It's all too often the case, not just for rent payments but all departments in my experience. Like you said on another thread, they are low paid, overworked and probably bored and confused with the role and all the regs.

    Thank you for sharing, I have come across this briefly very before. I am more interested now as I have a potential ten who really wants a house I have vacant and I know they are the perfect profile however we need their council to pay direct (a different one to the one I currently work with). Might just copy and paste the reg Smile
