    What is the point of a 6-month break clause?

    Hi all

    Often wondered this but never took action to find out. I have it as default on my agreements but never used.

    What is the point of having a 6 month break-clause on a 12 month tenancy agreement?

    If you are worrying about it, why not just do a 6 month agreement and let it continue as a periodic tenancy?

    Interested to hear any useful reasons for this clause.

    The main reason is that if after a few months they stopped paying you rent, you would have to wait until the end of the 12 month tenancy before you could serve a Section 21.  With a 6 month break clause you can serve the S.21 to coincide with the end of the tenancy (if served at the correct time of course)

    Why would you not serve a section 8 in this instance? Rather than wait until the end of the tenancy (or even for the break-clause) to act.

    Have you ever had to serve a S8 ? It can take 6 to 12 months to go through the courts and then for the bailiffs to evict the tenant whereas a S 21 is a lot quicker and simpler .

    So much more sensible to go just 6 months then rolling on periodic.


    Who wanted more than 6 months on AST and why, please?

    Or mortgage stipulates we must have AST and can't go to periodic.
