  • HMO & Multi-Lets

    257 HMO flats with only single tenant

    i have a 257 HMO in 3 flats but now only one tenant is resident leaving 2 flats empty for renovation.

    Its 3 floors + unused basement.

    does this change the fire regulations, as legally a HMO needs to be more than 1/3 rented out. I'm planning

    on getting the full work done, but it would be helpful if i can know what fire regulations are in this scenario right now.

    No, it doesn't change things if you intend letting the other flats out to tenants in the future.  To create an artificial situation where 3 flats becomes one just to avoid the regs would not be considered favourably by the regulatory authorities (ie. Council housing standards officers).  The danger is that they see through your plans and treat them as they are - an artifice.

    Best to just fess up and get it done properly to avoid the spinning blades and do-do if they investigate and find against you.

    thats not my intent. the council know the house, and i need to update the fire system, but i'm just trying to get more time if the regs are easier.

    its not artificial, they will be up to code when its rented out.

    So what changes for now?
