    2nd Charge Stamp Duty

    Hi guys,

Quick question (as I can't seem to find the answer) I own one property currently 50/50 with my father in my personal name. I'm looking to buy another one for a buy to sell project but through a ltd company this time, will it be liable for the second charge stamp duty?

From my understand it is, but I was confused slightly when exploring whether or not to put the flat in the company as we would then pay the extra stamp duty again.

    Thanks in advanced!

    Tom

Your circumstances mean you will pay the additional 3% sdlt if you purchase as a limited company or in your own name

I agree with Don Frump. Your '1st' home (with your father) is exempt from the additional 3% tax. Any 2nd property be it personal or as a business, will be liable for the extra 3%
