    6 month periodic?

    6 months rent was paid in advance on my original tenancy agreement - twice: it was an annual fixed term AST. It's coming to an end, though I have served a Section 21 which expires 10 days after the end of the tenancy.

    Even though it says the tenancy is monthly, does it mean I have a 6 month periodic tenancy when the original tenancy ends?  Are the courts likely to reject my Section 21, given that it gives 2 months' notice?  If I charge the tenant rent on a monthly basis while I apply to the courts, am I unwittingly setting up a new tenancy agreement, instead of a periodic?
