  • Tenant Referencing

    Advice on who performs tenant referencing

    Contract details: joint tenancy, was an AST for one month and is now rolling month to month. Contract has been going for years, with the most recent tenancy swap (one out one in) happening just over a year ago. 

    Not a landlord. I'm really sorry if this isn't allowed but I need help from landlords to help me understand this situation. 

    I want to leave this joint tenancy, so I've found a replacement and passed their details to the landlord. The landlord is demanding that I reference them myself, and pay for it too. I told him in not comfortable referencing them myself as I have no idea what I'm doing and it's quite sensitive information (also not 100% he can ask me that at all?!).

    He told me to get the agency to do it on my behalf but it might end up costing me more. 

    I popped into the agency and they told me that landlord has 'disinterested' them recently, meaning he's essentially fired them, so they're not managing the property anymore and can't get involved with referencing. 

    I emailed the landlord explaining the above and that it's his responsibility to reference the new tenant as it doesn't say I should in the contract so I'm not obliged to. He's now called my two housemates threatening that he'll kick us all out if I don't and said that I'm annoying him. They're obviously terrified now and pressuring me to just do it but I really don't think I should. 

    He keeps saying I'm breaking the contract by leaving but as I've nominated a replacement I don't think I am, it's not like it's fixed term it's periodic! 

    Is he in the right to ask me to do this? If not, what do I do?! How do I get through to this landlord? Is there some legislature I can point him to or someone I can get to step in? 

    Any advice would be really appreciated.
