    Boundary/ fences responsibilities

    I’m currently purchasing a BTL and on the land registry it looks like it’s my responsibility for the right hand side fences but on another form, that was filled out by the sellers, it states I'm responsible for the left hand side. When viewing the property the left hand side fence is in need of replacement/repair so it would make sense that left would be mine due to the condition of the house.

    This was the response from my solicitors:

    ”Your boundary responsibilities should be as per the title.  The Seller has merely confirmed what boundaries they have maintained during their ownership”

    Has anybody come across this before? What do you recommend?

    Your solicitor is right, you can always talk to the neighbour and agree to share the cost.

    Fencing- when looking at the garden with back to the house usually the fence on your left belongs to you and is your responsibility. Like wise when looking face on to the property from the front the fence on your right is next doors .

    I know the properties ive bought/owned before have all been to the left, but on the land registry/deeds it shows the 'T's' on the right hand side this is why i'm unsure especially when the seller states the left

    Hi, As a Fencing contractor for thirty years, I can assure you, the only safe way is to follow the title deeds if it is on there.

    There are no other rules than that! Of course you may always go halves with neighbour

    As an aside, its always best to chat with neighbour before works commence.

    Yes, from the deeds shown, with the 'T's within the red outline, they would indicate the RH side is yours, front and back.

    It used to be that the rule was often correct, especially when houses were laid out on straight streets, but nowadays housing estates aren't like that.

     The other reason that rule can not be applied is if for example there were 4 houses together  in a road, there would be 5 boundaries/fences, so sometimes one house is responsible for two boundaries.

    The left and back rule is only a rule of thumb and cant be relied upon

    I have had various weird variations on my deeds over the years .

    Some left, some right , some  back , some all 3 , some none

    Cheek the deeds and the lease and look for those `T``s  then talk to the neighbours

    Sometimes they will pay for something they dont need to because they want a prettier fence

    Take a deep breath before you speak though as boundary disputes tend to make peoples blood boil

    Some plots you can be responsible for both sides. Good advice above to go with the Title docs. We tend to replace any necessary fencing/panels on either side with neighbour's consent and they are very happy with that, shows we care about the property and being neighbourly...that can be beneficial over time when they can look out for your interests too.
