    BTL and Divorce

    Hi All,

    I'm hoping to invest in a buy to let using a joint mortgage with my sister. She is happily married but were she to get divorced, would her 'ex' husband be able to claim half of her share of the buy to let property?

    Would any rental income be classed as earnings and vulnerable to a claim as well?

    Yes but it would work the other way to if you ever got married.

    There are many, many variables and pretty much any outcome is possible. A lot depends on circumstances and even more depends on who has the better divorce solicitor.

    I can get the gist of most legislation relating to property but even after experiencing 2 divorces I'm none the wiser on divorce law.
