    Conservative micro policy launch

    I've just received the below email from my local conservative party.  If we could construct a decent policy that would win voters to the conservative party, as let's face it, the main reason politicians bring in poilicies is to win votes, then we may have a chance of getting a new tax regime for BTL that would actually benefit tenants.

    I think it has to be framed around benefitting tenants so that the conservative can try to win tenant votes as well as home owners.  Initial ideas that sproing to mind are:

    1) Remove stamp duty for properties build especially for rentals.

    2)  Cancel S24 obviously but this needs to be framed in a way to show the benefit to tenants, perhaps with some sort of cap on rental increases (inflation only unless there are sunstantial improvements to the property).

    3) Remove or reduce CGT (my favourite would be to remove lol) if a landlord sells to FTB or tenant.

    I write with very exciting news of our party's new policy initiative and of how you can play a key part and make a difference to the policy formation of our "new" Government.

    Our Government has formulated the idea of "Micro-Policies" and has handed this over to the national policy forum to see what the membership's creative policy-making instincts have to offer.

    What is a micro-policy? (you may ask).

    There are no absolute rules, but a good micro-policy is likely to be a self-contained piece of policy on a topic entirely of your choice. It may be local or national, appealing for implementation on its own, based upon Conservative values and may possibly be relevant to current events or current developments in politics. Or it may simply be just a really good idea on almost anything.

    Government wants realistic proposals to be submitted by members of local policy forums and passed to the relevant Minister for comment. Inevitably - this is politics – so if you come-up with something that's 'hot' there's a chance they'll run with it.

    Its up to you – and if your idea is good enough, who knows where it could lead!

    Micro-Policy Workshops

    We can all have great ideas and come-up with useful Micro-Policy suggestions. But I imagine that what most of us need is opportunity to explain, discuss, refine and develop policy ideas in a mutually-supportive environment. Advice and support, given and received, will see that together we can better develop and hone our ideas into their essence of effective policy.

    So I propose that Eastbourne and Willingdon CPF hold Micro-Policy Workshops where people can bring ideas and join with the forum to turn those ideas into policy that may work.

    Individual party members are always at liberty to make their own independent Micro-Policy submissions to CCHQ CPF should they wish. However, the benefit of a supportive group environment and assistance from like-minded members of Eastbourne CPF would be a great way to help people to have confidence in their ideas.

    I hope to encourage people to value their ideas and to bring them to the workshops. As sharing ideas can be a rather personal matter we will have a rule that every idea will be handled in confidence and treated with respect. No idea will be rejected – instead we'll vote for the strong policy ideas, encouraging and helping those members to complete the requisite official "Policy Development Form" for submission to CCHQ.

    I hope there will be sufficient interest to continue workshops on a monthly basis, taking on a social aspect like a cross between a policy workshop and a political coffee morning. You wont necessarily need to bring a policy idea of your own but you'll be able to meet friends, drink coffee and offer advice and encouragement to others.

Bring your ideas, don't be shy. We'll work together on ideas to distil them into the policy forum's completed policy development forms for submission to central office. If you don't have your own micro policy yet, don't worry, come anyway and help with others.

    Here's a micro policy

    Allow LL to evict with the assistance of police after 14 days any tenant who hasn't paid their full contractual rent.

    No requirement to attend court

    A very small policy that would massively assist LL and tenants alike!!

    How would the police know to assist? A hearing of some sort would be needed to check the facts. Also bad LLs would abuse it. There is a good reason why a court hearing is required.

    Some strenghening of section 8 would be good.

    No that is the whole point, court action delays the whole thing so NO going to court should be required.

    However if a LL stated an untruth of rent not being paid then the LL should be arrested for fraud.

    It would be clearly unacceptable for a LL to enable timely eviction by stating a falsehood.

    For that reason alone LL would seek confirmation that rent had not been received.

    It would also require a tenant to provide proof they had paid.

    If no such proof was provided and the LL had proof no rent had been received or rather the FULL rent had been paid then the LL could confidently risk his liberty by requesting police to remove them.

    Remaining in a rental property while not paying for the service is effective theft.

    Basically as soon as a tenant doesn't pay the full contractual rent tenants should be considered as squatters and removed by police being arrested if they refuse to leave.

    But we all know that timely eviction will never be allowed to occur.

    Which is obviously something that every LL especially those with mortgages should factor into their business model.

    Trouble is few LL do this.

    As a consequence such LL face real financial problems

    Whilst this would be great for landlords I can't see any government taking it up.  We need to present a policy that would actually win them votes if we have any chance of ot it being adopted.

    I would suggest this is only for rent arrears cases.

    Surely the public wouldn't support people living in accommodation and not paying for it until eventually removed by a lengthy legal process!!!??

    So for rent arrears only why shouldn't tenants be removed quickly if they fail to pay the full rent.

    It is effective theft of an accommodation facility.

    Try staying at the Ritz and not paying

    The rozzers would have in nick double quick!!

    I think you're missing the point.  If we have any chance of getting something accepted it has to be something that will them votes.  Right and wrong have nothing to do it with it and a policy of "You will be evicted if you don't pay your rent within 2 weeks" isn't a vote winner.

    Many will consider it unfair that tenants occupy property without paying for it

    There is no such thing as a Free lunch except perhaps if you are a tenant of a PRS LL!!

    Only the scroats would vote against timely eviction in cases of rent arrears and most of them don't vote!!

    I know your point was to avoid the delay of a court hearing. My point was that that it is unworkable. Some one would have to check that the LL is telling the truth before the police will assist, so a hearing of some sort is essential.

    I don't like to critize without offering an alternative, so how about this:

    Change the notice period for a section 21 to 3 months normally, or 1 month if the tenant has been 2 months behind with the rent at any time in the previous year.

    That gives more security to good tenants (which should win votes) but allows LLs to get rid of bad tenants faster which should be easily defendable.

    It isn't the notice period which is the big bugbear, it is removing the tenant who refuses to comply with S21

    I would accept the existing S21 process providing the tenants were removed on the day after the S21 expiration period By police if necessary.

    It is simply unsustainable for a Court process to be involved.

    But at the end of the day we have just a talking shop as no way will Govt change the eviction process.

    So I manage the whole dysfunctional process by using RGI.

    It isn't a perfect solution, but is the only one that works for me!
