    I have just taken over the management of my property from an agent.

    They forwarded me the tenants' deposit on March 25 but the new tenancy began on March 2.

    Do I have 30 days from March 2 to register the deposit or March 25?

    Deposit protection has nothing to do with tenancy start date, it is related to when the deposit was paid.

    You have 30 days from when the deposit was paid to register and protect the deposit, if the tenants paid it more than a couple of days before the tenancy started you may already be too late! In future I would ask the agent to register and protect as soon as they receive the deposit and confirm this to you, then the deposit can be transferred within the scheme to your account. If you do not trust the agent to do so, insist that the deposit is paid direct to you by the tenant and you handle protection.

    Sorry, I'm not sure I've been clear.

    Deposit was paid at start of tenancy to agent in March 2018. Agent held it for 12 months. Now agent has forwarded it to me because I have taken over the tenancy management. I got it from the agent on March 25, 2019. My logic says I have until April 24 to deposit it but I'm not sure. Can anyone clarify?


    If it's the case that the agent should not have passed it on to me then surely they must be in the wrong?
