As I've mentioned in other threads I have 1 inherited property which is held in trust and has been let for just over 3 years. I was informed by the trustees in November 2017 that the tenant had not paid any rent since May 2017, however they hadn't taken any action. I contacted the LA appointed by the trustees, who issued a S21, but neither myself not the LA could get the trustees to authorise it. Finally in April 2018 it was authorised and a court date was set (all I know is this was towards the end of April).
The LA (acting for the trustees) contacted me today to inform me that she has received confirmation that the court has ordered the eviction of the tenant. In addition the court has ordered possession form 23/05/2018 (tomorrow) and ordered repayment of all outstanding rent. The tenant has made an immediate payment of £1000 and provided documentation to show that 50% of the arrears can be cleared by the end of June.
It seems the system does work sometimes.

Unfortunately not Vanessa, my intention was always to sell.
I will receive the proceeds of the trust next month and I had informed the trustees at the beginning of 2017 that I wished to sell the property at the end of that year to avoid the 6 month rule for mortgages. This had all been agreed and was the main reason I found out about the arrears in November of last year. The trustees seem to operate to a different unit of time (6 months to sign a S21!) so even though I had a good plan it was not to be.
I had thought that the tenant may have been aware of my wishes and that was their reason to stop paying. When I found, and contacted, the LA it was clear that the topic hadn't even been discussed.
I've finally got the date for the bailiffs to attend and gain possession of the property - 5th September.

The deeds have finally been transferred from the trust today, 4 months after possession! I have a (very patient) cash buyer waiting to complete. I will hopefully receive the proceeds of the trust later this month... 7 months late.
