    Eviction through Trustees

    I have an inherited property, currently held in trust until June this year and let by the trustees. Early in 2017 I agreed with the trustees, via their paralegal, to continue renting until the end of the year and then sell the property so that I would receive a cash sum.

    The tenant last paid rent in May 2017 and I was made aware by the paralegal in June that the rent was late but plans were in place to cover the shortfall. It wasn't until November 2017 I was made aware that no further payments had been received. I asked why nothing had been done and the paralegal explained that they were waiting on the Letting Agent who the trustees had appointed.

    I contacted the Letting Agent directly, explained that I was the beneficiary, and was informed that a Section 21 was ready but authorisation was required to issue it. The trustees had yet to authorise it, despite several requests. After some discussion, the LA accepted my authorisation and issued the S21 in the first week of December. The LA was also not aware of my intention to sell and after a brief conversation with the EA the particulars were prepared. The trustees were still not available.

    The S21 now needs to be authorised for eviction which I am told I can't do, it must be the trustees. The trustees have appointed a new solicitor to manage the trust, but otherwise have still done nothing. I am in regular contact with the LA and we are both being told that the trustees are busy and will deal with it as soon as they have time - they haven't had time for over 3 months now!

    I have no issue with the tenant or the LA, I've lost a bit of rent but the property has been well looked after. I do have an issue with the trustees, how do I get them to authorise the eviction process and the sales agreement, they seem to be permanently busy?
