    Ex tenant dumping furniture

    Hi

    I have a tenant vacant under a section 21 notice. They have dumped a sofa outside a neighbour a few doors down. This neighbour is not happy about this and stating that she will report me to the council. Now my issue is I don’t see how I am responsible for my ex-tenant dumping furniture on the street.

    Any ideas what I can do to resolve this?

    You are not responsible for this and you are not liable.

    The neighbour should inform the police and the local authority team responsible for fly tipping and illegal rubbish dumping.

    I would suggest writing to the tenant telling them that if they do this again it will be reported and telling them about the services offered by the relevant local authority to remove large rubbish items.

    Normally not liable

    If though the property is a leasehold not a freehold then you could become liable depending on the terms of the lease

    You would then have to pursue the sub tenants  if action was taken by the freeholder against you

    I`ve had several incidences when i as the leaseholder am chased because of the actions of my tenants

    Its unfair of course but that`s the way it works sometimes
