    Dear Tribers

    I have a property which Ive owned since 2006 but it is solely in my name, can I transfer 90 per cent of the income and rent to my wife using the above form to mitigate S24? Would  I have to get her name on the mortgage or deed before I did so?

    If you transfer ownership you will trigger SDLT. Owner must be on the mortgage. If it was that easy, HMRC would be mugs and we’d all be slightly better off.

    I was under the impression that there was no SDLT if the transfer between husband and wife was treated as a gift
