    Giving notice using section 21

    Just checking that I can still use section 21 to terminate a tenancy, and I don't have to give a reason?

    I have  a stroppy kid living in an HMO on an individual AST for his room which is now periodic.  He is a difficult character and regularly behind with the rent. He owes about £1300 at the moment.  He views the rent payment as an option not an obligation.

    I can't be bothered to get into a section 8 argument and would prefer to give him two month's notice and terminate the tenancy without reason, using section 21.  I've issued the how to rent guide etc so all of the legal bases have been covered.

    Is there anything that I should be aware of?   He'll make a beeline for Citizens Advice etc. But a glance at his payment record tells the story.   Again I don't really want to get into a debate about that.  I just want him to leave and I'll take the rent arrears on the chin. He will without doubt not pay the last two months rent just to add to the pain.

    If I had any faith in section 8 I'd use it.

    The scumbags at Citizens Advice or the Local Council will give him the standard, but unlawful advice, of to sit tight and wait for the bailiffs to show up. If he's gone this side of Christmas you'll have done well. Sorry to be so pessimistic.

    Why are you so against a sec8? I've used it lots of times & never had a problem. Even manged to recover some rent arrears through an AOE.

    BTW Orson, council/CAB advice to stay put is not unlawful it merely advises T to wait for the whole lawful process of eviction.
