    Guarantor in the EU?

    Hi Guy's,

    Does anybody have any experience of / know if this can even happen in the UK but an EU potential tenent has a strong Guarantor in Portugal and I am just looking for anybody who has arranged such a scenario before?

    Hi Kev, I think you have to give consideration as to how difficult it would be to call upon a guarantor who is based abroad. In my day job (financial services), we never seek security from people based abroad as it is notoriously difficult to enforce. I would say a guarantor is no different, but that’s just my opinion.

    When/if we leave the EU, any enforcement route against a debtor in Portugal becomes unrealistic (at the kind of values a tenancy guarantor would be liable for). The current EU wide small claims process will (I assume) vanish as it's an EU initiative.
