    Hiring foreigner builders

    Hi everyone,

    Sometimes, I see foreigner builders standing around Homebase, Selco and other places and ask the question or holding a paper board "Do you have a job for me". If we hire them to do some gardening work or digging or cleaning work etc, is that ok?

    They will expect to pay cash and I don't think, we can get an invoice from them.

    Any thought to use these workers?

    The maximum penalty is £20,000 per illegal worker with no upper limit, but its not likely to be relevant in this scenario as the Right to Work legislation only applies to employees and workers and not sub contractors or self employed.

    My god.. That is a hefty fine.

    The last time, I found two builders who did the drive way for me and installed the storm porch for me. I wonder, if he knows about this rule.

    I was tempting to ask for the telephone number of one of the foreigners who said that he can build brick wall using stone slab.

    I often see people sleeping rough near the Euston square station area, I wonder whether the police stop and ask for IDs and the rights to be in the UK?

    You'd have to see if the have insurance cover. Otherwise could sue you for any injury that happens when doing work at your place. Also unlikely that they have any personal indemnity cover to do the work.

    Just go via recommended routes as there's no way to validate their work. What if the Gardner is ends up simply being a surveyor of your house to see what items to steal? - extreme examples but i wouldn't have any trust built with these types of people so I wouldnt go down this route.

    I doubt Police have any interest in potential illegal immigrants/rough sleepers as they would leave that to Borders Agency etc.

    Had a really good Polish guy do some work. He gladly gave me an invoice with full name, address, phone number etc. Some time later tied to contact him again for further work to find address did not exist and I was told  he had returned to Poland.

    I had paid by bank transfer to him once via his wife account. Is my invoice valid and acceptable, at what point does an invoice cease to be kosher?

    In practice I doubt HMRC will try to contact the Polish builder - and you have bank's evidence that he was paid.

    The media are saying a lot of East Europeans have now repatriated themselves.

    Using foreign builders isn't really the issue here is it, foreign builders are fine.  The question seems to be more about using illegal migrants to get a job done cash in hand.

    Irrespective of legality, that to me is morally wrong for many reasons.
