Important new decision from the Court of Appeal

The Court of Appeal handed down a decision yesterday in Charalambous v Ng on tenancy deposit protection.

This decision means that landlords who took deposits prior to the introduction of the tenancy deposit legislation and whose tenancies became periodic before the legislation came into force now have to take urgent action. These landlords were previously outside the decision in Superstrike v Rodrigues as they had not received a deposit while the legislation was in force.

We registered all of ours with MyD soon as the deposit protection came in; it just wasn't worth the hassle letting courts decide our fate!

Yes the decision requires swift action by land lords. They need to get themselves registered quickly. (*Moderator note: Rest of comment removed*).
