is letting agent responsible for payment?

Before tenants' full deposit was returned 2 months ago by the new letting agents, damage on a bed was noticed compromising its stability, but tenants said it was like that before. Evidence shows otherwise. Beds in the inventory were undamaged and inspection carried out by the old letting agency, on 23 September 17, tenants said there were no issues.

I feel the new letting agents are responsible for cost of repair or repurchase, as they only took the word of the last tenants. I was not communicated with regarding return of deposit at any stage. is there a body or organisation who l get the backing off? letting agent located in Edinburgh.

Contact the TDS Tenants Deposit Scheeme they can advise.  They are arbitrary.  Good luck.

The tenants' have had their full deposit returned 2 months ago and are no longer resident. Will TDS still advise me about this situation? Do you think the letting agents or l should fork out the cost? l do want to be on good terms with them, but if they are legally responsible then they will have to pay.

It would appear you may have a case against the agent. I would put a complaint into them first and exhaust there complaints procedure first and then if you not happy with the result then ask which redress scheme they use and follow your complaint through.

This is Scotland.  Do perhaps TDS & redress scheme not apply?
