  • HMO & Multi-Lets

    Is this an HMO or FHL?

    I have been trying to gain an understanding of the definitions of different types of shared let, B&B, airbnb, hostel, FHL, HMO, and there appears to be a fair amount of crossover.

    I have been considering where a lodging/boarding house fits within this, where rooms are let on a Mon-Fri basis. Although it would appear to be an HMO, it doesn't fit the criteria for main home. If the landlord is resident, at some point it will likely become a B&B. If the landlord is not resident it seems to fit the criteria of a FHL.

    In fact, FHL seems easy to achieve. Available for 210 days (it will be available for 260), let for 105 (it doesn't have to be fully let), no lettings for more than 31 continuous days. Have I missed something? I can't find anything that states a FHL must be a single let.

    I can see many advantages to this over letting the property as an HMO.

    • No HMO licence required
    • Business Rates instead of Council Tax (so no ICTB) - possibly small business relief
    • Not affected by S24
    • Capital Allowances available
    • Lower CGT, 10% instead of 28%
    • Business Property Relief may be available
