    Management company making up charges

    Hi Guys,

    A good friend showed me his latest bill from the management company - his building has only 2 residential flats with a commercial unit at the bottom.  The managing company charges for "management fee" and "sundries" and "professional fees" - all these generic terms in the one bill!  There is regular cleaning charges set up that he's never been consulted on for a stairwell that doesn't look clean.  I have read up on requesting detail and receipts from the management company and I have templates to request this formally - though any advice would be welcome

    What I really want to know is - he's paid these bogus bills for 7 years now - and unfortunately just paid the last one - what can we ask for refunds on?  Obviously I'll threaten to take them to the tribunal, but is it just the most recent bill we can contest, or can I ask for receipts for the last 7 years?

    Overcharging is rife in the mixed use leasehold sector. Obviously look at the lease and see what and what can not be charged for. Also have a chat with the commercial tenants to see if they are happy. The rights are limited in mixed use buildings but look into setting up a ‘ recognised tenants association’  good advice can be found on NLC campaign on Facebook
    If found to be breach of contract you can go back to the start of the contract/lease to claim any overpayments plus interest.
