    New landlord mistakes - non compliant tenancy

    Hi
     
    My wife and i have made the massive mistake of renting our property out to  family of a very good friend without a contract or even a TDS set up as we didn't know what we were going to do long term and this was fine with the tenants .

    Now everything thing has gone  sideways . The tenants are not looking after the property and we want them out but they won't go until we evict them as they want a council house  .. any tips please ??

    This is not something that you are going to get fixed here. You need to get a solicitor.

    It is probably fixable by serving a section 8 notice and returning the deposit but it will be a little bit time consuming and complex.

    In general terms of you think they are not looking after the property, then you need to make sure you have strong evidence of that, so gather that now

    The law states that even if no AST is in place, say a verbal agreement.  That the rules of an AST are still enforceable. Section 8 eviction.

    Need more info -

    Are they paying the rent? If yes then eviction using a Sec8 will be discretionary and at the whim of a judge - If you are evicting for damage to Property the council may refuse to house them, are the Tenants aware of this?

    As above looks like you need a Solicitor or Eviction Specialist.

    I know this sounds bonkers but think it thru...

    Offer them a new written tenancy with all paperwork - GSC, EPC, deposit protection etc - but at LOWER rent.  Hope & pray they will sign (probable). 


    After 6 months evict, s21.


    Alternative? Stay with current verbal one, pain, costs, sufferring for months & months.


    Do not rent to friends or relatives of combinations thereof...

    Good to see you artful guess you are same on another property forum great advice as usual shame you aren’t as active here though, definitely a fountain of knowledge
