  • Deposit Protection

    Refunding deposit - couple split up ...

    Can some please advise,

    I have a property where a couple have been renting.

    One of them has served notice (on a dual tenancy agreement) that they will be leaving in 1 month as per there tenancy agreement.

    But the other tenant (who happens to work for me) wants to stay on at the property but has asked that I give them the deposit money and they will make sure the partner that they are splitting up with will get there ½. I am inclined to just do this as it does have nothing to do with me and I am giving the money back to a tenant on the agreement.

    Do I have any legal obligation to make sure the other tenant gets their share of the deposit, is that not down to them to sort out by themselves? I suppose I am asking legally am I covered.

    Thank you. so I just need to tell the tenant leaving that they need to sort it out between them.

    You need to get both the tenants to nominate a lead tenant to deal with all matters relating to the deposit
