    Repair Liability

    Hi

    We've had situations where water has damaged a flat or adjoining property. Some owners have then requested we carry out repairs. However, in most cases they either do the repair themselves or claim their insurance policy. In one case, they have demanded we pay the excess on the insurance policy.

    However, according to the CLA, this is only legally enforcable if they can prove that the damage occurred because you were negligent e.g. if you were repeatedly told about a leak and failed to get it repaired within a reasonable timeframe.

    There is the legal position and then there is the moral position, it depends if you think they should pay your excess if it was the other way round.
