  • Deposit Protection

    Return of tenancy deposit

    As a landlord I have used a fully managed service and have never got into the detail of tenancy deposits, although I'm aware of the requirements. I'm unsure of the best course of action regarding my partner's deposit which has not been returned. Tenancy commenced 01/03/2017 and ended 28/02/2019. Checkout has been completed and no issues raised.

    I have a receipt from the letting agent that she dealt with for £750 and a disclaimer that they are not liable to protect the deposit as this was a tenant find only service.

    The AST states that a deposit of £500 is required and will be held. It gives the landlord's property agent's address, not the LA's address for correspondence. I know this address as it is a local tailoring service.

    I don't have the landlord's address.

    I've checked DPS, TDS and MyDeposits but there is no record of the deposit being protected.

    Who do I chase for the return of this deposit? I have a template 'letter before action' but I'm not sure where to send it.

    You are allowed to know the landlord's address and the lettings agent should supply it.  Contact the landlord and ask for the deposit back in full, stating that you know it was un-protected.

    I've already prepared the letter. I'll get the valid address from the letting agent on Tuesday.
