    SDLT - Linked; Non-resi

    Looking at purchasing a HMO/flats and has a car park at rear on a separate title.

    If split cost of  purchasing both could it be classed as mixed-use so non-residential SDLT applies?

    I’m not a lawyer and this comment should not be taken as fact but I believe SDLT is self assessed so doing it would be at yours and your solicitors risk. I think.

    HMRC could contend that the car park is land that subsists for the benefit of a dwelling bringing it within the definition of residential.

    The car park is currently rented out separately to another group (a city centre solicitors office).

    ah in that case if in one transaction should be linked and therefore mixed I would say
