  • Problem Tenants

    Serving notice - difficult tenants

    Hi

    I wish to server notice on my tenants who first took tenancy on April 2017 and I gave them another tenancy  another year contract in April 2018, so renewed it.and it's not periodic tenancy.

    Now to serve notice do I need section 21 or section 6a? Also where and which version  can I give them of a document right to rent and where would I get it from.

    If any one has the correct version that would be applicable in my case please let me have them. If you can pm me. Would be most grateful . Ta

    If you gave them another 12 month fixed term contract in April 2018 then you can't use a section 21 to evict them during the fixed term.  If you have grounds then you could look to evict them using section 8.  But this will depend on the grounds you have for eviction.  You'd be best advised to speak to someone in the legal profession about the eviction.

    No arrears they pay the rent on time but just damages which they are not accepting when I spoke to them.

    Do you have a break clause in the agreement, does it expire in April 2019, if so serving a section 21 6a, maybe fruitless now, as there is another 6 months to run. 

    ​Are there any arrears or other breaches?

    Hi

    there is a break clause which I thought I could excercises now in November. So may I use section 21 or 6? I wanted to use section 8 for damages but not sure . Just worried the quickest and best way to get them out. But fear it's going to be along journey! They love the place and have no plans to go anywhere.
