    Tenant changing rooms - new AST required?

    I have a very good tennant who wishes to change rooms in our HMO. Only reason is the other room is bigger. I'm happy to do this but my agent wants her to sign a new agreement.

    Is there not a way of just signing a form to tranfer the Tenancy from one room to another in the same house.

    Is the room furnished? A new inventory would be in order to start with. Does it state room number in the Tenancy Agreement?

    I would suggest, subject to inventories of both rooms and agreement for any deductions from the bond, that an addendum might suffice stating the change and the circumstances.

    Yes furnished. Inventory done and will be on changing rooms. I'm  just wondering if there is an ammendment that can be done to the tennancy agreement as opposed to issueing a new one.

    It might only be a change of rooms but in the eyes of the law it is a change of property.  Particularly because each tenancy agreement should specify the room to which it applies.  You need to be sure you have covered everything legally and for this reason it is generally best to get another tenancy agreement signed.  It doesn't have to be for a fixed term it could be done as periodic from the beginning.

    We would recommend checkout of the old room and checkin to the new room to ensure the deposit is being treated correctly.

    dont forget the new law applying to deposits and fees will apply to the new ast.

    Also have a weather eye on the Deposit Passporting thing coming up soon, which will affect this type of situation in future.
