  • Problem Tenants

    Tenant in arrears wants new tenancy agreement

    We have a tenant in around 2-3 month of arrears at this moment in time and have served a section 8 notice based on their rent arrears. We bought the property as a buy to let and the tenant was already in place.

    When we took over the property we never actually got the tenant to sign a new tenancy agreement, should I even bother with this now, seeing as unless they pay up for the outstanding rent I'll be looking to have them removed in 2 months time?

    Would it cause a problem if I don't get them to sign up to a new tenancy agreement should we need to evict them?

    Any advice on this would be much appreciated

    Did you serve notice(s) compliant with s48 & s3 shortly after you purchased?

    If not...

    a) No rent due (s48..) so s8 invalid &

    b) Perhaps criminal offence & fines (s3..)

    As long as notice(s) are served (& deposit protected, even if you never got it..) you are fine.  If not served, oh dear.

    NEVER give anyone in arrears a new tenancy.

    Depending on when they 1st moved in it might not be an AST. Before 1997 or 1989 it would almost certainly be an AT (no s21..) or a "Rent Act" (so not s8..) tenancy, notwithstanding any shiny new signed AST.

    They seem oblivious as to what is required

    Surely they must be very poorly advised by solicitors!?

    How can these people become LL when so poorly advised.

    I have come to realise that most LL don't know what they need to know but don't even bother finding out what they need to know.

    I work on the basis that I don't know what I need to know and therefore ensure that I find out what I don't know!!!

    I can't believe how many idiot LL there are!!
