    Tenant in rent arrears and AST

    Hi

    I let a two bed flat to two sharers. They have been in the property for one year and all has been fine. I have now taken over the management from the agent and now one guy has paid but the other has not  and is ignoring my messages. Rent was due on March 1.

    It's further complicated by the fact that a new TA came into effect on March 1 but I have not signed it (the agent has got things wrong and has yet to correct them) and I don't know if the tenants have signed it.

    The reason for going to a new AST rather than letting the old one lapse to a periodic was because the one tenant doesn't pass financial referencing so pays six monthly and the agent told me that I would only be able to get monthly payments rather than six monthly which would invalidate my LL insurance.

    My question for now is should I chase payment on the old TA, that is one month, or the new one, six months? From what I have read it could make a difference if I have to evict.

    If the new agreement has not been signed, how can you hope to enforce it?

    I would stick with the old periodic asa and chase them for that.

    Presumably this is joint & several.  If so serve s8g10 TODAY on both.  Yes, s8g10 may validly served if only 1p is underpaid for only 1 day.


    EACH joint tenant is liable for ALL outstanding rent -unless someone has unwisely written about "shares"...

    I am going to serve a section 8 on the tenants. Can anyone tell me how to do this if I can't do it in person?

    Should I pay someone to do it?

    Or can I send it recorded delivery?

    Is there any way to cancel an AST?

    The agent has emailed an AST to tenants for them to sign and I now want to evict for non payment.

    The AST demands that one of the tenants pays six months upfront which would delay me being able to evict them.

    I haven't signed myself.

    I need to keep them on the original AST which has now lapsed into a periodic so I can evict them.

    Can anybody help?
